As a Referral Program participant (a “Referrer”), you are subject to Recess’s Terms of Service and Privacy Policy, as well as the following additional Terms & Conditions for Recess’s Referral Program (the "Program"). By participating in the Program, you accept these Terms. The Program is operated by Nook Workspace Pty Ltd trading as Recess ("Recess", "we", "us").

• Eligibility. The Program is open to individuals who are aged 18 or over and located in Australia. It is for personal, individual use only and may not be used by businesses for affiliate or lead-generation purposes, as determined by Recess in its sole discretion.
• Qualified Referral. A "Qualified Referral" is a purchase (an "Order") completed at recess.com.au by a person (a "Referred Customer") who arrived at our website by clicking your unique Referral Program link. The Referred Customer must be a new customer who has not previously purchased from Recess. You are limited to one Qualified Referral for each Referred Customer; in other words, additional or repeat purchases made by the same Referred Customer are not counted as additional Qualified Referrals.
• Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address, account, or payment method). Recess may cancel any Reward issued on this basis at its discretion.
• Referral Rewards. For you to earn referral rewards as a Referrer, the Referred Customer must complete an order on the Recess website. Recess discount codes cannot be combined or stacked. 
• Earning a Reward. To earn a Reward as a Referrer, the Referred Customer must complete and pay for an Order on the Recess website. A Reward is earned for each Qualified Referral. If the relevant Order is cancelled, returned, or refunded (in whole) before the Reward is issued, the Qualified Referral is void and no Reward is payable.
• Rewards. Each Reward has a value of A$50 and may be taken as either a $50 discount code applied to a future Order at recess.com.au; or a $50 cash refund applied to a past Order (cash refunds are available to existing Recess customers only). You may choose one option per Reward - a discount or a refund, not both. To claim a cash refund, email our customer service team at hello@recess.com.au and quote your valid Reward code. Each Reward code is single-use and cannot be combined or stacked with any other Recess discount code or offer. Reward codes have no cash value except as expressly set out above.
• Timing & Expiry. Rewards become payable 35 days after a Referred Customer has received their Order. You have 365 days from the date a Reward becomes available to claim it, after which the Reward expires.
• Tax. As a Referrer, you are responsible for any and all tax liability resulting from Rewards you receive under the Program.
• No Spam. You must comply with all applicable anti-spam laws. Your Referral link should be created and shared in a personal manner with people you know; bulk email distribution is strongly discouraged. Any distribution of your Referral link that could constitute unsolicited commercial electronic messaging or "spam" under any applicable law or regulation is expressly prohibited and is grounds for immediate termination of your participation in, and exclusion from, the Program. You confirm that you have a personal relationship with, and a reasonable basis to contact, anyone with whom you share your link.
• Fraud & Misuse. Recess reserves the right to withhold or cancel Rewards, to close the account(s) of any Referrer and/or Referred Customer, and to request proper payment, where the Referrer and/or Referred Customer attempts to use the Program in a questionable manner, breaches any of these Terms & Conditions, or is in violation of any law, statute, or governmental regulation.
• Changes & Cancellation. Recess reserves the right to cancel the Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed Rewards will be forfeited at that time.
• Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. To the extent permitted by law, Recess's liability in connection with the Program is limited to the value of the relevant Reward.
• General. These Terms apply in addition to Recess's Terms of Service and Privacy Policy; in the event of any inconsistency in relation to the Program, these Terms prevail to the extent of that inconsistency. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect. These Terms are governed by the laws of New South Wales, Australia.
